Jockey Luis Saez is to appeal a 15-day suspension for causing interference in the Kentucky Derby which cost his bracket Maximum Security victory.
The Kentucky Horse Racing Commission announced the decision by the Kentucky stewards on Monday, nine months.
An attorney for Saez says the suspension is”unwarranted” and the rider’s legal team will file an appeal within 10 days and seek a stay of proceedings.
“He needed a flawless ride at the Kentucky Derby and there is no reason that the stewards must have given any discipline to him,” lawyer Sean Deskins said.
“He did everything he was required to do and that was within his ability to control the horse”
Saez has been cited for failing to”make the appropriate effort to maintain a straight course” from the race at Churchill Downs.
Country House was announced the winner with Maximum Security demoted to 17th of the 19 horses.
The stewards’ ruling comes after the commission refused an appeal of Maximum Security’s disqualification . The fast denial of the commission came hours after West declared Maximum Security would not run in the weekend Preakness at Pimlico in Baltimore.
The commission stated stewards’ decisions aren’t subject to appeal. Additionally, it denied a request.
West and his wife, Mary, said in a statement late last week that they were assessing their legal options.
They said using a”just and appropriate hearing of our situation Maximum Security is going to be restored as the winner.”
Stewards disqualified Maximum Security after specifying the colt impeded the route of several horses between the much and final turns of their 1-1/4-mile (2000m) race.
Maximum Security was before veering and making contact with War of Will, who retreated, Long Range Toddy and Bodexpress.
Country House was involved on the outside and although he did not seem seriously influenced, his rider Flavien Prat registered an objection and said Maximum Security interfered with his horse.
