Jockey Luis Saez would be to appeal a 15-day suspension for causing interference in the Kentucky Derby that cost his mount Maximum Security success.
The decision by the Kentucky stewards was announced by the Kentucky Horse Racing Commission on Monday, nine days.
An attorney for Saez claims that the suspension is”unwarranted” and the rider’s legal staff will file an appeal within 10 days and seek a stay of proceedings.
“He needed a flawless ride at the Kentucky Derby and there is no reason that the stewards should have given any subject into him,” lawyer Sean Deskins said.
“He did everything he was needed to perform and that was within his power to control the horse”
Saez has been cited for failing to”make the appropriate effort to keep a straight course” in the race at Churchill Downs.
Country House was announced the winner with Maximum Security.
The stewards’ ruling comes after the racing commission denied an appeal of Maximum Security’s disqualification . After West announced Maximum Security wouldn’t run in this weekend Preakness at Pimlico in 24, the commission’s fast refusal came.
The commission stated stewards’ decisions are not subject to appeal. It also denied a petition to stay the disqualification ruling pending appeal.
West and his wife, Mary, said in a statement late last week they were evaluating their legal choices.
They stated with a”just and appropriate hearing of our case Maximum Security will be restored as the rightful winner.”
Stewards disqualified Maximum Security later specifying the colt impeded the route of many horses between the far and final turns of the 1-1/4-mile (2000m) race.
Maximum Security was close to the railroad before making contact with Bodexpress, Long Range Toddy and War of Will, who retreated and veering.
Country House was included on the exterior and although he didn’t appear seriously affected, his rider Flavien Prat filed an objection and stated Maximum Security interfered with his horse.
